The entire content of the VDMA website is protected by copyright. You are only permitted to download or print individual pages and/or segments of the website if you use the content for the intended purpose. Copyright notices must not be removed or altered. Any copying, transmission or alteration is prohibited outside the narrow confines of copyright law without prior written consent of the VDMA.
The VDMA makes every effort to ensure that the information presented is accurate and free of error. The VDMA cannot accept liability for loss or damage of any kind which is directly or indirectly related to the access to, use of, service offered on or requests sent to the VDMA website or its links to other websites
The activation of certain links on the VDMA website can cause the user to leave the website. The VDMA has not checked these links or their contents and thus accepts no liability for the technical quality or content of external sites, above all with respect to the products, services or other features offered therein.
Terms of use for my.VDMA.org
The following terms and conditions apply for the relationship between the user of my.vdma.org and the VDMA as operator of the website. The use of my.vdma.org is allowed only if the user accepts these terms of use.
1. Registration
In order to use the services provided on my.vdama.org users have to register. Users are not authorised to make personal access data available to third parties. Users are obliged to keep access data secret and protect them against third party access.
2. Services of the VDMA
The VDMA strives to keep its services available on my.vdma.org and shall not assume further obligations. In particular, users have no claim to uninterrupted availability of the service. The VDMA does not guarantee the accuracy, completeness, reliability, timeliness and usefulness of the content provided.
3. Terms of Use
Users are prohibited from publishing content that offends against common decency or violates existing law. Users shall respect copyright, trademark and unfair competition laws and are obliged to make sure that they posses all necessary intellectual property rights on the posted content.
The VDMA as a leading trade association promotes free and fair competition. Therefore, the VDMA committed itself to all requirements of antitrust law in its Compliance Program. The Compliance Program is available in the member area of my.vdma.org. Users agree to respect the rules of competition law when using my.vdma.org. These rules explicitly prohibit anti- competitive agreements or to discuss or share other sensitive corporate data.
In case of non-compliance with these Terms of Use, the VDMA reserves the right to change or to delete the corresponding content and to block the access of the user. The user is obliged to compensate the VDMA for any damage caused by the violation of the Terms of Use. The VDMA also reserves the right to delete content and contributions if there is a risk of alleged infringement of the Terms of Use. The VDMA shall be indemnified from any liability for loss or damage third parties may suffer because of the user's failure to comply with the Terms of Use.
4. Copyright
The copyright of user-posted content remains with the user. However, by using the services of my.vdma.org, users commission the VDMA to make user-posted content permanently available to the public on my.vdma.org. The VDMA has the right to move posts within its website and to connect them with other contents. Claims for deletion or correction of user-posted content against the VDMA are excluded.
5. Limitation of Liability
Damage claims by the user are excluded unless otherwise agreed in the following. The preceding liability limitations and exclusions also apply to legal representatives or auxiliary persons of the VDMA if the user asserts a claim against the latter. The liability limitations and exclusions are not applicable to damage claims resulting from damages to life, body, health and claims for damages resulting from a violation of essential contract obligations. Essential contractual obligations are those that are necessary to attain the objectives of the contract. Furthermore excluded from the limitation of liability shall be damage claims which result from intentional or grossly negligent breach of duty from part of the VDMA, its legal representatives or auxiliary persons.
6. Data Protection
The VDMA is authorized to collect, process, store and use the personal data of users that are necessary to use my.vdma.org. This includes the specification of personal data collected such as the IP address, e-mail address, name, company, business address and any other communication data, application date, etc. The VDMA guarantees that the personal data communicated to it will be treated confidentially. 6.1 Google Analytics
The VDMA uses Google Analytics, a web analytics service provided by Google, Inc. (“Google”). Google Analytics uses “cookies”, which are text files placed on your computer to help the website analyze how users use the site. The information generated by the cookies about your use of the website (including your IP address) will be transmitted to and stored by Google on servers in the United States. In case of activation of the IP anonymisation, Google will truncate/anonymise the IP address for Member States of the European Union as well as for other parties to the Agreement on the European Economic Area. Only in exceptional cases, the full IP address is sent to and shortened by Google servers in the USA. On behalf of the website provider, Google will use this information for the purpose of evaluating your use of the website, compiling reports on website activity for website operators and providing other services relating to website activity and internet usage to the website provider. Google will not associate your IP address with any other data held by Google. You may refuse the use of cookies by selecting the appropriate settings in your browser. However, please note that if you do this, you may not be able to use the full functionality of this website. 7. Termination of Membership
Users may terminate membership by submitting an appropriate declaration to the VDMA; the access will be activated upon request.
The VDMA is entitled to terminate membership at 2 weeks notice at the end of the month. In the event of good cause, the VDMA is entitled to block an access immediately and to terminate membership without notice.
Upon membership termination, the VDMA is entitled to block the access of the user. Upon membership termination the VDMA is entitled, but not obliged, to delete user-posted content . Claims on the transfer of user-posted content are invalid.
8. Modification or Cancellation of the Offer
The VDMA is entitled to make changes to its service. The VDMA is entitled to terminate service at 2 weeks notice at the end of the month. Upon service termination the VDMA is entitled, but not obliged, to delete user-posted content.
